The H-2B visa program is part of the United States Citizen and Immigration Service (USCIS) otherwise known as the Department of Homeland Security. In conjunction with the U.S. Department of Labor (DOL), employers who can prove a temporary, seasonal or periodic recurring need for full-time workers in particular job titles that cannot be filled with U.S. workers are certified to bring in Temporary Foreign Workers to fill those positions for a specific period of up to 9 full months. The processing and requirements are significantly different from J-1 visa workers who are students allowed to work on a temporary basis if their stay in the USA is tied to cultural exchange. To be certified, employers are required to provide payroll and tax documentation showing that their need for seasonal labor for a specific job title is periodic or traditionally tied to a season of the year by an event or pattern of a recurring nature.
